Arizona Producer License

Certificate of Disclosure — Form E-178
Arizona requires a Certificate of Disclosure (Form E-178) for certain licensing and company registration activities. The Certificate of Disclosure must include:
- All prior names and aliases used by the applicant or company
- All addresses for the preceding 7-year period
- Full disclosure of any past convictions (criminal or otherwise) or judicial actions taken against the company, partners, directors, or principals

Producer Administrative Action and Criminal Prosecution Disclosure
Arizona requires that insurance producers affirmatively disclose the following:
- Any administrative action taken against the producer in another jurisdiction must be disclosed to Arizona DIFI within 30 days of final disposition
- Any criminal prosecution (regardless of state) must be disclosed within 30 days of the initial pre-hearing date — not upon conviction; disclosure is required at the earliest stage of the criminal proceeding

Suitability Standard — ARS §20-448
Arizona Revised Statutes §20-448 establishes suitability requirements for annuity transactions. Under this statute, insurance producers must:
- Make reasonable efforts to obtain information about the consumer's financial situation, insurance needs, financial experience, financial objectives, intended use of the annuity, financial time horizon, existing assets (including insurance and annuity contracts), liquidity needs, liquid net worth, risk tolerance, and tax status before making any recommendation
- Only recommend annuity products that are suitable based on the information obtained from the consumer
- Not recommend a replacement or exchange of an annuity unless there is a reasonable basis to believe the replacement or exchange is in the best interest of the consumer
- Maintain records of the basis for all recommendations

Arizona Privacy Notice — A.R.S. §20-2101 et seq. (Arizona Insurance Information and Privacy Protection Act)
Arizona's Insurance Information and Privacy Protection Act (A.R.S. §20-2101 et seq.) provides Arizona insurance consumers with privacy rights that differ significantly from the generic Gramm-Leach-Bliley Act (GLB) framework:
- Opt-in required: Unlike the GLB opt-out model, Arizona generally requires affirmative permission (opt-in) before sharing your personal information with non-affiliated third parties. Your information will not be shared with non-affiliated entities without your affirmative consent.
- Right to access: You have the right to access personal information we maintain about you in connection with an insurance transaction
- Right to correct: You have the right to correct inaccurate personal information in our records
- Right to know: You have the right to know what personal information has been collected and how it is used

Life Insurance Illustration Act
Arizona has adopted the Life Insurance Illustration Act, which establishes specific disclosure thresholds for illustrated policies. Key requirements include:
- Illustrations for life insurance policies must distinguish between guaranteed and nonguaranteed elements — projected values based on current assumptions must be clearly labeled as non-guaranteed
- Insurers must formally notify the Arizona Director of Insurance whether a given policy form will be marketed with or without an illustration — this choice must be made at the product level and cannot be inconsistently applied
- If an illustration is used in the sale of a life insurance policy, you must receive a copy of the illustration at the time of application
If you are shown any illustration of projected policy values during a consultation, you are entitled to a copy and are encouraged to review the guaranteed column carefully.
Holding Company Filings — Forms B, C, and F (Arizona)
Arizona requires domestic insurance holding company systems to file Forms B, C, and F with the Arizona DIFI. Arizona-specific rule: these filings are state-only filings submitted directly to Arizona DIFI — they are not transmitted to the NAIC. This differs from NAIC model law, which may contemplate NAIC involvement. This is an insurer-level regulatory obligation disclosed here for informational purposes.
Arizona Insurance Code — ARS Title 20
Arizona Revised Statutes Title 20 governs the conduct of insurance companies and producers in Arizona. Key consumer protections include:
- Unfair trade practices (ARS §20-443): Prohibits misrepresentation, false advertising, and unfair discrimination in the sale or service of insurance
- Prohibited practices (ARS §20-448 et seq.): Establishes standards for ethical conduct and suitability in annuity transactions
- Free-look period: Arizona law requires a free-look period for life insurance and annuity contracts, during which the policyholder may return the contract for a full refund of premiums paid
- Replacement disclosures: When replacing an existing life insurance policy or annuity contract, Arizona law requires specific disclosure documents comparing the existing and proposed coverage
Replacement of Life Insurance and Annuities
If you are considering replacing an existing life insurance policy or annuity contract with a new one in Arizona, you are entitled to:
- A completed replacement comparison worksheet before the application is finalized
- A written comparison of the benefits, costs, and surrender charges of the existing and proposed coverage
- Time to review the replacement documents before signing
- Notification that the existing insurer may be contacted as required by Arizona replacement regulations
Do not lapse, surrender, or cancel any existing coverage until a replacement policy is issued and confirmed in force.
