Texas Producer License
Sasson Emambakhsh is licensed as a non-resident insurance producer in the State of Texas under License #3460699. This license authorizes the discussion and placement of life insurance, disability insurance, long-term care insurance, and fixed annuity products for Texas residents.

Texas Insurance Code — §4054 (Agent Duties)
Under Texas Insurance Code Chapter 4054, insurance agents licensed in Texas owe specific duties to consumers, including:
- Acting honestly and in good faith in all dealings with insureds and prospective insureds
- Accurately representing the terms, benefits, and costs of insurance products
- Not making material misrepresentations about policies or carriers
- Disclosing the nature of the agency relationship and any compensation arrangements that may affect recommendations

Consumer Bill of Rights
Texas mandates distribution of the Consumer Bill of Rights at the time of application for homeowners, auto, and certain other personal lines. The Consumer Bill of Rights explains consumer rights regarding claims handling, premium increases, cancellation and nonrenewal, and privacy. For the insurance lines Sasson Emambakhsh discusses with Texas consumers (life insurance, disability insurance, long-term care insurance, and fixed annuities), analogous consumer protection rights apply under the Texas Insurance Code, and you are entitled to receive relevant disclosure materials explaining those rights before or at the time of application.
Credit-Based Insurance Scoring — 28 TAC Chapter 5
Texas Administrative Code Chapter 5 (28 TAC Chapter 5) establishes specific requirements for the use of credit information in insurance underwriting and pricing:
- Carriers must disclose to each applicant — orally or in writing — that a credit report may be obtained and used to develop a credit score that could affect the premium for the policy
- Texas provides consumers with opt-out rights with respect to the use of credit information for insurance scoring
- If a credit score adversely affects your rate or eligibility, you have the right to request re-evaluation after certain qualifying events (e.g., divorce, death of a spouse, identity theft, medical emergency)
If credit information is used in connection with your application, you will be so notified as required by 28 TAC Chapter 5 before or at the time of application.
Texas Overhead Assessment (TOA) / Texas Edition Forms
Texas requires insurance carriers to file Texas-specific Texas Overhead Assessment (TOA) forms and to use "Texas Edition" forms for supplemental reporting instead of generic NAIC blanks. These are insurer-level compliance requirements. As a consumer, this means the forms and filings applicable to your policy are Texas-specific and have been reviewed by the Texas Department of Insurance — not merely adopted from NAIC model documents without Texas review.
Holding Company Disclaimer of Affiliation — Texas Rule
Unlike the NAIC model (which provides for deemed-effectiveness after 30 days), Texas extends the deemed-effective period to 60 days for holding company disclaimers of affiliation filed with TDI. Additionally, TDI retains the authority to nullify a disclaimer of affiliation even after it has become effective. These are regulatory filing obligations at the insurer or holding company level; however, this disclosure is provided so that Texas consumers understand their regulatory framework differs from the NAIC standard in this respect.
Corporate Governance Annual Disclosure (CGAD)
Texas has adopted the NAIC Corporate Governance Annual Disclosure (CGAD) Model Act. The Texas-specific rule specifies that CGAD filings must be submitted only to the lead state of the insurance group — they are not submitted directly to the NAIC. If TDI is the lead state, filings go to TDI. This is an insurer-level obligation disclosed here for informational purposes.
Suitability of Annuity Recommendations
Texas Insurance Code and Texas Department of Insurance regulations require that annuity product recommendations be suitable for the consumer based on the consumer's individual circumstances. Before recommending an annuity product to a Texas consumer, a reasonable effort will be made to obtain information about your financial situation, insurance needs, financial experience, financial objectives, intended use of the annuity, time horizon, existing assets, liquidity needs, liquid net worth, risk tolerance, and tax status.
Any recommendation will be based on this information and will place your interests above those of the producer. You will be provided with written documentation of the basis for any recommendation.
Texas Data Privacy and Security Act (TDPSA)
The Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024, grants Texas consumers the following rights with respect to their personal data:
- Right to access: You may request confirmation of whether we are processing your personal data and access to that data
- Right to correct: You may request correction of inaccuracies in your personal data
- Right to delete: You may request deletion of personal data you have provided to us
- Right to data portability: You may request a copy of your personal data in a portable format
- Right to opt out: You may opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling. We do not sell personal data, engage in targeted advertising using your data, or use data for profiling purposes.
To exercise any of these rights, submit your request to [email protected] or call (702) 970-3811. We will respond within 45 days. If we are unable to act on your request, we will inform you of the reason. You have the right to appeal a refusal to act on your request.
Texas Replacement of Life Insurance
Under Texas Insurance Code and TDI rules, when a new life insurance policy or annuity contract is intended to replace an existing policy or contract, specific procedures and disclosures are required:
- You will be asked to complete and sign a replacement comparison worksheet if a replacement transaction is involved
- A Notice Regarding Replacement of Life Insurance or Annuities will be provided and must be signed and retained
- The existing insurer may be notified of the replacement as required by TDI regulations
- You will receive a full comparison of the existing and proposed policies, including costs, benefits, and any penalties for early surrender
Important: Do not cancel or allow any existing insurance policy to lapse until a replacement policy is issued and in force. Carefully review all replacement disclosure documents before making a decision.
